Two men in suits shaking hands

On September 4, 2014, actress and comedienne Joan Rivers underwent what was supposed to be a routine endoscopy procedure—but she never woke up. She passed away at Mount Sinai Hospital. Following her death, investigations have been made, resulting in some shocking discoveries regarding the behavior—and negligence—of the medical staff involved in Rivers’ endoscopy.

Attorneys for Rivers’ estate have filed a medical malpractice lawsuit, claiming that Rivers’ family (namely her daughter Melissa Rivers) wants to make sure that the negligence and malpractice that ultimately led to Joan’s death are “never repeated by any outpatient surgery center.”

According to the lawsuit, the doctors who performed the endoscopy at the Yorkville Endoscopy clinic failed to monitor Joan’s medications or her weight before sedating her. The lawsuit also alleges that the doctors performed a laryngoscopy without Rivers’ written consent.

In addition to these negligent acts, it is also alleged that Rivers’ doctors allowed a “selfie” to be taken with Rivers’ while she was sedated.

Ultimately, reports show that Rivers’ oxygen saturation and vital signs were not properly monitored while she was sedated. As a result, Rivers suffered brain damage due to lack of oxygen, allegedly as a result of a second laryngoscopy that the doctors performed – again without Rivers’ consent – which arguably compromised her airway and oxygen levels.
